1. Acceptance of Terms

By accessing or using PrestoCam ("Service", "Platform", "we", "us", or "our"), operated by PrestoCam Team, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of those changes.

2. Eligibility & Geographic Scope

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account and purchase paid features. The Service is controlled and operated primarily for users in the United States. We make no representations that the Service is compliant with laws outside the U.S.

3. Description of Service

PrestoCam provides a web-based suite for online video creators, offering:

• Automated AI-assisted script and reaction suggestions for publicly available video content.
• A browser-based recording studio with an integrated teleprompter, enabling video creation without external software downloads.

4. Accounts and Security

When you create an account, you must provide accurate and complete information. You are solely responsible for:

• Maintaining the security and confidentiality of your access credentials.
• All activities, content creation, and credit usage occurring under your account.
• Notifying us immediately at support@prestocam.com of any unauthorized access or security breach.

5. Acceptable Use & Fair Use Guidelines

You agree NOT to use PrestoCam to violate any laws, infringe third-party rights, or distribute harmful, deceptive, or defamatory material.

Reaction Video & Copyright Compliance

• Platform Rules: You agree to strictly abide by the Terms of Service and Community Guidelines of YouTube and any other video distribution platform, including all time, format, and fair use boundaries.
• Transformative Content: You agree to use PrestoCam to create original, transformative work that adds your own distinct viewpoint, analysis, commentary, or educational value to original material.
• Proper Attribution: You agree to provide proper credit and attribution to the original content creators within both your final video production and the corresponding upload descriptions.

7. Subscriptions, Payments, and AI Credits

• Billing Cycles: Paid access is offered via monthly or annual subscription plans, as well as lifetime access options where applicable. Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal.
• Failed Payments: If automatic payment processing fails, we reserve the right to suspend access to paid features until the balance is settled.
• AI Credits: Platform credits awarded via subscription or daily refills represent a limited, non-transferable license to access specific AI features. Credits have no cash value, do not constitute stored value, and cannot be redeemed or refunded.
• Refunds: Except when required by law, paid subscription fees and lifetime purchases are non-refundable. Refund requests are evaluated strictly on a case-by-case basis at our sole discretion.
• Fee Changes: We reserve the right to modify pricing structures upon reasonable prior notice.

8. Third-Party Services, APIs, and Platform Disclaimer

PrestoCam relies on third-party infrastructure, payment processors (e.g., Stripe), hosting providers (e.g., Vercel, Supabase), and external Application Programming Interfaces (APIs) from third parties such as YouTube or AI model providers.

• API Changes: If any third-party service provider or API ceases to be available to us on reasonable terms, we may modify or discontinue dependent features without providing refunds, credits, or compensation. Your sole remedy is to cancel your subscription.
• Feedback License: If you provide suggestions or feature requests, you grant us an unrestricted, royalty-free, perpetual license to implement them without any obligation or compensation to you.

9. Copyright Complaints & Takedowns (DMCA)

If you believe content on the Platform infringes your copyright or likeness rights, please contact us at support@prestocam.com with a description of the material, its location, and proof of authorization.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ANY GUARANTEE REGARDING:

• The accuracy, quality, or viral performance of AI-generated reaction scripts.
• Uninterrupted, error-free, or secure operation of the browser recording tools.
• Non-infringement of third-party copyright claims resulting from user productions.

11. Limitation of Liability & Force Majeure

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESTOCAM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR REVENUE ARISING OUT OF YOUR USE OF THE SERVICE.

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including server failures, internet outage, or third-party service disruptions.

12. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any breach of these Terms or illegal activities.
